Overview

Welcome to Charmette. The terms "Charmette," "we," "us," and "our" refer to Charmette.

Charmette operates Charmette.shop and the related websites, accounts, features, tools, products, promotions, rewards programs, memberships, customer-support channels, social-media interactions, and services that we make available to you (collectively, the "Services").

Our ecommerce store is powered by Shopify, which provides technology that allows us to offer products and Services to you.

These Terms of Service ("Terms") govern your access to and use of the Services. These Terms should be read together with our:

By accessing or using the Services, creating an account, placing an order, enrolling in an optional membership or rewards program, or otherwise using Charmette, you agree to these Terms.

If you do not agree to these Terms, you should not use the Services.

Section 1 – Eligibility, Accounts, and Access

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.

Recurring paid memberships and other transactions requiring a payment method must be entered into by a person legally capable of entering into the applicable agreement.

When creating an account, placing an order, joining a program, or contacting us, you agree to provide information that is accurate, current, and reasonably complete.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

Please notify us if you believe your account has been accessed or used without authorization.

We may suspend or restrict an account when reasonably necessary to investigate fraud, abuse, unauthorized activity, security concerns, violations of these Terms, or misuse of our programs or Services.

Section 2 – Products and Product Information

Charmette makes reasonable efforts to display and describe our products accurately. However, product photographs, colors, finishes, scale, and appearance may vary depending on lighting, photography, manufacturing variation, screen settings, device settings, or other factors.

Minor variations that do not materially affect the intended use of a product may occur.

Product descriptions, designs, specifications, prices, availability, packaging, promotions, and assortments may change from time to time.

We may discontinue a product or limit quantities available for purchase.

Nothing in this section limits any rights you may have when a product arrives damaged, defective, incorrect, or materially different from what was ordered. Those situations are addressed under our Return & Refund Policy.

Section 3 – Product Use, Sizing, and Care

You are responsible for using products in a reasonable manner and following any product-use or care instructions made available by Charmette.

Italian charm bracelets are modular products containing movable and removable components. Bracelet fit may vary depending on wrist size, number of links, number of charms, and personal comfort preference.

Section 4 – Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the products shown in your order.

Receipt of an order confirmation does not necessarily mean that we have finally accepted or fulfilled the order.

We may decline, cancel, limit, or hold an order when reasonably necessary, including because of:

  • Product unavailability
  • A material pricing or listing error
  • Payment failure
  • Suspected fraud or unauthorized payment activity
  • Duplicate or abusive orders
  • Violation of a promotion
  • Violation of these Terms
  • A shipping or fulfillment restriction
  • Another legitimate operational or legal reason

If we cancel an order after payment has been successfully collected, we will issue the appropriate refund for the canceled portion.

We may limit quantities or restrict purchases that reasonably appear to be intended for unauthorized commercial resale, fraud, manipulation of promotions, or another use inconsistent with the intended consumer nature of the Services.

Section 5 – Order Changes and Cancellations

If you need to change or cancel an order, contact us as quickly as possible.

We will make a reasonable effort to accommodate a request before fulfillment, but changes and cancellations cannot be guaranteed once processing or fulfillment has begun.

If an order has already shipped, our Return & Refund Policy may apply.

Section 6 – Prices, Taxes, Currency, and Billing

Product prices and promotions may change from time to time without advance notice, except where notice is required by law.

The price presented and accepted at checkout generally controls the purchase, subject to correction of obvious or material errors.

Applicable taxes, shipping charges, duties, fees, or other charges may be added where required or disclosed during checkout.

Charmette is based in the United States. Where our website displays another currency, currency conversion may be provided for convenience through Shopify or another service provider.

Exchange rates and rounding may cause small differences in converted prices.

By submitting an order, you authorize the applicable payment provider to charge the payment method you selected for the amount disclosed at checkout.

If we discover a material pricing error before fulfillment, we may contact you, cancel the affected item, or provide the option to purchase at the correct price.

We will not retroactively increase the price of an accepted purchase without your agreement.

Section 7 – Shipping, Tracking, and Delivery

Order-processing and delivery timelines are estimates rather than guaranteed delivery dates unless Charmette expressly states otherwise.

Shipping timelines may be affected by carriers, customs, weather, holidays, volume, destination, international handoffs, or other circumstances.

However, the existence of a carrier delay does not prevent you from contacting Charmette if your order appears lost, significantly delayed, incorrectly delivered, or otherwise affected by a delivery problem.

Nothing in these Terms limits rights or remedies that cannot lawfully be waived under applicable consumer-protection law.

Section 8 – Returns, Refunds, Replacements, and Defects

Returns, refunds, damaged products, defective products, incorrect products, missing products, omitted promotional items, cancellations, and related remedies are governed by our Return & Refund Policy.

Charmette may provide a refund, replacement, remake, store credit, goodwill benefit, or another reasonable resolution depending on the circumstances.

A customer is not automatically entitled to multiple forms of compensation for the same loss or incident.

If an order, item, or charge has already been refunded through Charmette, a payment processor, bank dispute, chargeback, or another method, Charmette may take that prior reimbursement into account when determining whether any additional financial remedy is appropriate.

Section 9 – Custom and Personalized Products

Charmette may offer personalized products, including our Custom Image Charm .

When you provide an image, photograph, name, phrase, design, or other material for use in a personalized product, you represent that:

  • You own the material or otherwise have permission to use it for the requested purpose
  • The requested use does not unlawfully infringe another person's rights
  • The material is not unlawful, fraudulent, or malicious

You grant Charmette and the production providers involved in fulfilling your order a limited license to reproduce, format, transmit, manufacture from, and otherwise use the submitted material solely as reasonably necessary to create, fulfill, remake, support, or resolve issues concerning your personalized order.

Submitting a private image for a custom product does not grant Charmette a general advertising or public-marketing license to that image.

Charmette may decline a customization request that we reasonably believe violates law, intellectual-property rights, platform requirements, or these Terms.

Personalized-item returns and quality issues are governed by our Return & Refund Policy.

Section 10 – Promotions, Free Gifts, Discounts, and Promotional Items

From time to time, Charmette may offer discounts, free products, free gifts, promotional bundles, store credit, social-media rewards, limited-time pricing, or other promotional offers.

Unless otherwise stated, promotions:

  • Apply only during the period in which the offer is active
  • Apply only to qualifying products or orders
  • May have purchase thresholds or other eligibility requirements
  • May be limited to one use per customer, account, household, order, or promotion
  • May not be combinable with every other discount or promotion
  • Have no cash value unless expressly stated otherwise

The specific terms displayed with a promotion at the time of purchase are incorporated into these Terms.

A promotional threshold and a product-sizing recommendation are separate concepts. For example, the number of qualifying charms required for a promotion does not necessarily represent the number of total links required to fit a particular wrist.

If Charmette's system shows that you qualified for a promotional item but the item was accidentally omitted, please contact our support team.

Charmette may correct obvious promotional errors or prevent misuse, manipulation, automated exploitation, duplicate redemption, or other abuse of a promotion.

We will not use this section to avoid honoring a legitimate promotion for which a customer actually qualified.

Section 11 – Charmette Rewards Program

Charmette may operate a voluntary rewards and loyalty program that allows eligible customers to earn points through qualifying purchases and other designated activities.

Participation in the rewards program is subject to these Terms and the applicable privacy disclosures contained in our Privacy Policy and Notice of Financial Incentive .

Rewards Currency

The current rewards conversion rate is:

1,000 points = $1.00 in Charmette store credit.

Rewards points:

  • Are promotional loyalty benefits
  • Are not legal tender
  • Have no cash value outside Charmette
  • Cannot be redeemed for cash
  • Cannot ordinarily be sold, assigned, or transferred between customers

Purchase Earning Rates

Current purchase earning rates are:

  • Bronze: 40 points per $1 of eligible spend
  • Silver: 50 points per $1 of eligible spend
  • Gold: 60 points per $1 of eligible spend

At the current conversion rate, these are approximately equivalent to 4%, 5%, and 6% of eligible spend in Charmette store-credit value.

Other Current Earning Opportunities

Eligible activities may currently include:

  • Creating an eligible account: 250 points
  • Adding a birthday: 250 points
  • Annual birthday reward: 1,000 points
  • Eligible daily website visit: 5 points
  • Eligible social-media activities: up to 750 points per qualifying activity as shown in the rewards interface

Optional activities such as providing your birthday or completing social-media actions are voluntary.

Current VIP Tier Thresholds

  • Bronze: 10,000 qualifying points
  • Silver: 12,500 qualifying points
  • Gold: 15,000 qualifying points

Tier qualification, earning rates, and benefits are determined by the rewards system and the current rules displayed to participating customers.

Rewards, Coupons, and Tier Benefits

Charmette may provide tier-entry benefits, store credit, coupons, limited-time rewards, or other promotional benefits.

A particular reward may include:

  • A minimum purchase requirement
  • An expiration date
  • A redemption limit
  • Product restrictions
  • Discount-stacking restrictions
  • Another condition displayed when the reward is issued

Those specific conditions become part of the reward terms when the reward is issued.

Returns, Refunds, and Points Adjustments

If a purchase that earned points is canceled, returned, refunded, reversed, charged back, or otherwise undone, Charmette may reverse or adjust the points, tier progress, rewards, or other benefits that were earned from that transaction.

If store credit, a reward, or a promotional benefit was used on a refunded purchase, the amount returned or restored may reflect the portion actually paid and the terms applicable to the reward used.

Rewards may not be used to generate cash profit, artificial transactions, circular purchases, or duplicate benefits.

Rewards Abuse and Errors

Charmette may investigate and correct:

  • Duplicate point awards
  • Technical errors
  • Fraudulent purchases
  • Artificial account activity
  • Multiple accounts created primarily to obtain duplicate rewards
  • False social-media reward claims
  • Returned or charged-back transactions that previously earned points
  • Other manipulation or abuse of the rewards program

Where reasonably supported by the facts, Charmette may adjust points, reverse rewards, suspend rewards participation, or close a rewards account associated with fraud or material abuse.

Changes to the Rewards Program

Charmette may modify the rewards program, including earning opportunities, conversion rates, tiers, thresholds, benefits, redemption rules, and eligible activities.

We may also suspend or discontinue the program.

Where required by applicable law, we will provide appropriate notice before a material change takes effect.

Current program information presented in the Charmette rewards interface should be reviewed when participating because earning opportunities and promotional benefits may change.

Section 12 – Store Credit and Gift Cards

Charmette store credit, promotional credit, rewards credit, and gift cards may be subject to different conditions depending on how they were issued.

Unless otherwise required by law or expressly stated:

  • Promotional store credit is not redeemable for cash
  • Rewards credit is not redeemable for cash
  • Credits may be associated with a particular customer account
  • Promotional credits may have expiration or minimum-purchase requirements if disclosed when issued
  • Credits may be reversed if obtained through fraud, error, refund manipulation, or program abuse

Statutory rights applicable to purchased gift cards are not limited by this section.

Section 13 – Charm Club Membership

Charmette offers an optional recurring membership currently known as Charm Club.

The current standard membership price is $24.94 per month, unless a different price or promotional offer is clearly disclosed when you enroll.

Automatic Renewal

Charm Club is a recurring subscription. By enrolling and providing the required affirmative consent, you authorize the applicable payment provider to charge the disclosed membership fee and applicable taxes to your selected payment method on a recurring basis until the membership is canceled.

The billing frequency, price, material membership terms, and cancellation information will be disclosed during enrollment.

Membership Benefits

Membership benefits may include special member pricing, exclusive offers, early access, priority support, promotional benefits, or other features displayed in the current membership offer.

Membership benefits may change over time. Any material changes will be handled in accordance with applicable law.

Cancellation

You may cancel your membership to prevent future renewals using the cancellation method made available for your membership or by following the instructions in the applicable membership policy.

Where applicable law requires a particular method of cancellation, Charmette will provide that method.

Cancellation generally prevents future recurring charges and does not automatically reverse a charge that was already properly processed.

Membership-related refunds, billing issues, cancellations, and other membership matters are governed by the applicable membership terms and our Membership Refund & Cancellation Policy .

Membership Price Changes and Notices

Charmette may change the membership price or terms prospectively.

Where required by law, we will provide advance notice, renewal reminders, price-change notices, or other required disclosures before applicable changes or renewals.

Section 14 – Optional Lifetime Warranty

Charmette may offer an optional paid Lifetime Warranty with eligible purchases.

The Lifetime Warranty is an optional product or service and is separate from the standard defect and return protections described in our Return & Refund Policy.

Purchasing an ordinary Charmette product does not automatically mean that Lifetime Warranty coverage was purchased.

Warranty eligibility and coverage are determined by the terms presented when the Lifetime Warranty is purchased.

Section 15 – Social Media, Comments, and Automated Messaging

Charmette operates accounts on social-media platforms and may use automated tools to help manage social interactions.

When interacting with Charmette through a social platform, you also remain subject to that platform's own terms and policies.

Comment Moderation

Charmette may moderate comments and other content appearing on pages, posts, advertisements, or accounts we control.

We may hide, remove, restrict, or decline to respond to content that reasonably appears to be:

  • Spam
  • Scams
  • Malicious promotion
  • Harassment
  • Threats
  • Abusive content
  • Fraudulent content
  • Clearly irrelevant content
  • Content that violates platform rules or applicable law

A legitimate customer complaint is not automatically prohibited merely because the customer expresses frustration.

Automated Responses

Charmette may use automated systems, including tools such as ManyChat, to provide responses, answer common questions, deliver promotional messages, or route customer-service concerns.

Automated messages may ask for information such as an order number and the email address used to contact our support team.

Order-specific customer-service decisions requiring investigation or judgment are normally handled through Charmette's customer-support process.

An automated statement that an action will be reviewed or escalated is not itself confirmation that a refund, replacement, cancellation, shipment, account change, or other operational action has been completed.

Social Support Routing

When a customer posts an order-related complaint publicly, Charmette may use automation to move the conversation into a private message so personal information does not need to be posted publicly.

Social media is generally used as an intake, communication, and support-prioritization channel rather than a replacement for our primary order-support process.

Section 16 – Social Tags, Mentions, and Promotional Rewards

Charmette may offer rewards to customers who complete qualifying social-media activities such as tagging or mentioning Charmette.

Eligibility may be determined through the applicable social platform, promotional system, or automation.

Simply claiming that an activity occurred does not automatically create entitlement to a reward when the applicable qualifying action cannot be verified.

Social rewards may be limited by account, customer, promotion, qualifying action, time period, or other disclosed conditions.

Duplicate, automated, fraudulent, or otherwise abusive claims may be denied or reversed.

Section 17 – Reviews, Public User Content, and Feedback

If you voluntarily submit a product review, public testimonial, suggestion, idea, comment, photograph, video, tagged social-media post, or other content intended for public interaction with Charmette ("User Content"), you represent that you have the right to submit that content.

Unless otherwise prohibited by law, you grant Charmette a non-exclusive, worldwide, royalty-free license to reproduce, display, repost, distribute, adapt for formatting, and otherwise use that User Content in connection with Charmette's website, social media, advertising, marketing, customer communications, and business operations.

This license does not automatically apply to private photographs or files submitted solely for production of a customized product.

You may contact Charmette to request that we stop using particular User Content in future marketing where reasonably practicable. This does not necessarily require removal of materials already printed, distributed, published, or incorporated into completed campaigns.

Charmette will not require you to change or remove a legitimate review as a condition of receiving a refund, replacement, or other resolution you are otherwise entitled to receive.

Section 18 – Intellectual Property

The Charmette website and its original content, including text, graphics, product photography, designs, branding, logos, website elements, and other materials, are owned by Charmette or used under permission from their respective owners.

These materials are protected by applicable copyright, trademark, and other intellectual-property laws.

Charmette and associated branding may not be used in a manner that falsely suggests affiliation, endorsement, authorization, or sponsorship.

Nothing in these Terms grants you ownership of Charmette's intellectual property.

Section 19 – Acceptable and Prohibited Uses

You may not misuse the Services, including by:

  • Using the Services for an unlawful purpose
  • Attempting fraud, payment fraud, chargeback abuse, or refund abuse
  • Creating accounts primarily to manipulate rewards or promotions
  • Submitting false information to obtain benefits
  • Attempting to gain unauthorized access to an account or system
  • Introducing malware, malicious code, or harmful automated activity
  • Scraping or interfering with the Services in a harmful or unauthorized manner
  • Impersonating another person
  • Infringing intellectual-property or privacy rights
  • Harassing or threatening Charmette personnel or other users
  • Using the Services in a manner intended to disrupt their normal operation

Nothing in this section prohibits a customer from making a good-faith complaint, seeking a lawful refund, filing a legitimate payment dispute, posting an honest review, or exercising a legal right.

Section 20 – Fraud, Chargebacks, and Duplicate Compensation

Charmette reserves the right to review transactions, accounts, rewards activity, returns, refunds, replacements, and claims for evidence of fraud or abuse.

Filing a legitimate chargeback or payment dispute does not itself violate these Terms.

However, knowingly seeking multiple financial recoveries for the same transaction or intentionally providing false information may constitute abuse.

If funds have already been returned through a successful bank dispute, payment-provider dispute, prior refund, or similar process, Charmette may consider that reimbursement when evaluating any additional refund or compensation request.

Section 21 – Third-Party Services and Optional Tools

The Services may incorporate or link to tools, applications, payment providers, social platforms, tracking services, rewards providers, or other services operated by third parties.

Third-party services may be governed by their own terms and privacy policies.

Charmette is not responsible for the independent practices of a third party merely because its service is linked from or integrated with our website, except to the extent responsibility cannot lawfully be excluded.

Section 22 – Relationship With Shopify

Charmette uses Shopify to power portions of our ecommerce experience.

Purchases from Charmette are transactions between you and Charmette, except where another party is expressly identified as the seller or provider.

Shopify may independently process certain information or provide certain consumer-facing services under its own terms.

Section 23 – Privacy

Our collection, use, sharing, retention, and other processing of personal information is described in our Privacy Policy.

The Privacy Policy also contains information concerning:

  • Cookies
  • Advertising and targeted advertising
  • AI-assisted systems
  • Social-media automation
  • Rewards-program data
  • Privacy rights
  • Our Notice of Financial Incentive

Section 24 – Errors, Inaccuracies, and Omissions

From time to time, the Services may contain typographical errors, inaccurate information, technical errors, outdated information, or omissions relating to products, pricing, promotions, availability, descriptions, shipping, or other matters.

We may correct errors and update information when reasonably necessary.

If a material error affects an order that has not yet been fulfilled, we may contact you, cancel the affected portion, provide a refund, or offer another appropriate solution.

This section does not allow Charmette to retroactively rewrite an accurately presented and accepted purchase simply because a later business decision would be more favorable to us.

Section 25 – Electronic Communications

By using the Services, you agree that transactional, account, order, support, policy, and other legally permitted communications may be provided electronically.

These communications may include order confirmations, shipping updates, account notices, support responses, membership notices, privacy notices, and other communications related to your relationship with Charmette.

Consent to these Terms does not by itself constitute consent to receive every form of promotional marketing where separate consent is required by law.

Section 26 – Suspension and Termination

Charmette may suspend or terminate access to an account, rewards program, promotion, membership feature, or other Service when reasonably necessary because of:

  • Material violation of these Terms
  • Fraud or attempted fraud
  • Security concerns
  • Material rewards or promotion abuse
  • Unauthorized account access
  • Illegal conduct
  • Serious harassment or threats

Termination does not eliminate payment obligations, rights, remedies, refunds, consumer protections, or other obligations that arose before termination.

Section 27 – Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

Charmette does not guarantee that the website will always be uninterrupted, completely error-free, or free of every technical defect.

To the fullest extent permitted by law, we disclaim implied warranties that may otherwise apply to the Services, except where a warranty cannot legally be excluded.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, CONSUMER RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Product-specific warranties and the optional Lifetime Warranty, where purchased, are governed by their applicable terms.

Section 28 – Limitation of Liability

To the fullest extent permitted by applicable law, Charmette and its owners, officers, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to the use of the Services, where such damages may lawfully be excluded.

This limitation does not apply where liability cannot legally be excluded, including rights or remedies provided by applicable consumer-protection law.

Nothing in these Terms is intended to exclude liability for fraud, intentional misconduct, or another category of liability that cannot lawfully be waived.

Section 29 – Indemnification

To the extent permitted by law, you agree to indemnify and hold Charmette harmless from third-party claims, liabilities, damages, and reasonable expenses resulting from:

  • Your material violation of these Terms
  • Your unlawful misuse of the Services
  • Content you submit that unlawfully infringes a third party's rights
  • Your fraudulent or intentionally wrongful conduct

This section does not require you to indemnify Charmette for Charmette's own unlawful conduct, negligence where such indemnification is prohibited, or another liability that cannot legally be shifted to you.

Section 30 – Events Outside Reasonable Control

Charmette will not be responsible for a failure or delay caused solely by circumstances reasonably outside our control, such as severe weather, natural disasters, governmental actions, transportation interruptions, widespread carrier disruptions, labor disruptions, major technology outages, or similar events.

This section does not eliminate obligations to provide refunds, replacements, cancellations, or other remedies where required by applicable law or another Charmette policy.

Section 31 – Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except to the extent another jurisdiction's mandatory consumer laws apply.

Subject to any rights that cannot lawfully be waived, disputes relating to these Terms or the Services may be brought in the appropriate state or federal courts located in Arizona.

Nothing in this section prevents a consumer from relying upon mandatory rights or venues provided by applicable law.

Section 32 – Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will continue in effect.

Section 33 – Waiver

Charmette's failure to enforce a provision of these Terms in a particular circumstance does not permanently waive our right to enforce that provision or another provision later.

Section 34 – Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Charmette may assign or transfer these Terms in connection with a merger, acquisition, financing, corporate restructuring, sale of assets, reorganization, or transfer of the business or applicable Services.

Section 35 – Entire Agreement and Policy Hierarchy

These Terms, together with the policies, disclosures, and specific offer terms incorporated by reference, constitute the agreement between you and Charmette relating to the applicable Services.

Where a specific Charmette policy governs a particular subject, that more specific policy controls for that subject.

For example:

  • The Privacy Policy controls with respect to personal-information practices.
  • The Return & Refund Policy controls with respect to eligible returns and ordinary refund procedures.
  • The Shipping Policy controls with respect to shipping and delivery procedures.
  • Specific membership terms presented at enrollment control the applicable membership offer.
  • Specific promotional terms presented with an offer control that promotion.

Section 36 – Changes to These Terms

Charmette may update these Terms from time to time to reflect changes in our business, Services, products, programs, technology, legal requirements, or operating practices.

The updated Terms will display a revised Last Updated date.

Where required by law, we will provide additional notice or obtain consent before a material change becomes effective.

Changes will apply prospectively as required by applicable law and will not retroactively eliminate rights that cannot lawfully be removed.
